Right of withdrawal (consumers — distance contracts)
1. Scope
The right of withdrawal under Articles 52 et seq. of Italian Legislative Decree 206/2005 (Consumer Code) applies to purchases made on www.moliniriggi.it by consumers (natural persons acting for purposes outside their trade, business or profession).
It does not apply to orders placed by business/wholesale (B2B) customers, including wholesale account holders.
2. Withdrawal period
You have the right to withdraw from the contract, without giving reasons, within 14 days of the day on which you or a third party designated by you acquires physical possession of the goods.
To meet the deadline, it is sufficient to send your withdrawal communication before the 14-day period expires.
3. How to withdraw — digital function (art. 54-bis)
For online contracts, we provide a digital withdrawal function allowing you to submit your withdrawal declaration and receive confirmation on a durable medium (email).
You can access it at any time during the withdrawal period at:
- dedicated page Right of withdrawal;
- My Account → My orders, “Right of withdrawal” on each eligible order;
- link in order confirmation emails and in the site footer.
The procedure requires your details (name, order number, email) and confirmation via a separate “Confirm withdrawal” button. You will receive an electronic receipt with date and time of submission.
Alternatively, you may send an explicit withdrawal declaration to info@moliniriggi.it or Riggi M.& A. Fratelli srl, Via Borremans 116, C.da Busiti — 93100 Caltanissetta (CL), Italy, using the model form in Annex I, Part B, of the Consumer Code.
4. Effects and refund
If you withdraw, we will reimburse all payments received, including delivery costs (except supplementary costs for non-standard delivery), without undue delay and in any event within 14 days of being informed of your decision.
We will use the same payment method as your original transaction unless otherwise agreed. We may withhold the refund until we receive the goods back or until you provide proof of shipment.
Return shipping costs: unless otherwise stated in a promotion, return shipping costs are borne by the customer.
5. Returning products
You must return the goods without undue delay and in any event within 14 days of communicating your withdrawal. Products must be intact, unused and — where applicable — returned with original packaging and seals unbroken.
6. Exceptions for food products (art. 59)
The right of withdrawal does not apply, among other cases, to:
- art. 59, lett. d) — goods liable to deteriorate or expire rapidly;
- art. 59, lett. e) — sealed goods not suitable for return for health or hygiene reasons if unsealed after delivery (e.g. opened flour bags, pasta or drinks).
For sealed packaged food (flours, pasta, drinks, yeasts, etc.), withdrawal is available only if products are intact, unopened and fit for resale within 14 days of delivery. Breaking the seal or altering packaging generally voids the right of withdrawal.
We assess refund eligibility case by case based on the condition of returned products.
7. Pre-contractual information (art. 49)
Before concluding the contract we inform you — via this section, the Terms and Conditions and the checkout page — of the conditions, time limits and procedures for exercising the right of withdrawal, and of the digital withdrawal function under art. 54-bis.
Withdrawal cannot be exercised before the contract is concluded and becomes available after purchase for the applicable withdrawal period.
